It often exploits ambiguity, emotional appeals, or fine print to mislead without technically breaking laws in some cases, though many jurisdictions regulate it under consumer protection frameworks.

 


MISLEADING ADVERTISEMENT AFFECTS CONSUMERS IN MULTIPLE WAYS:


1.      Financially, they might waste money on something that doesn’t deliver as promised—think diet pills that don’t work or gadgets that break instantly.

2.      It erodes trust in advertising and brands, making people skeptical even of honest marketing.

1.      Patanjali’s Massive Fallout: In 2024, the Supreme Court of India slammed Patanjali Ayurved for deceptive ads claiming cures for serious ailments like diabetes and asthma. The court found 26 of its advertisements misleading, leading to a ban on its marketing activities and the removal of 14 products from shelves. Patanjali’s audacity peaked when it falsely marketed “Coronil” as a COVID-19 cure in 2020, despite no scientific backing, prompting a public apology after intense legal scrutiny.

 

2.      Widespread Offenders: A 2017 report by the Advertising Standards Council of India (ASCI) flagged 200 companies for misleading ads, including giants like Hindustan Unilever (HUL), Danone, and Himalaya Drug Co. HUL’s Lever Ayush soap claimed to be rooted in “5,000-year-old Ayurvedic scriptures” with “15 herbs,” but ASCI found these claims unsubstantiated, exposing how even big brands stretch the truth.

 

3.      Health Risks for Kids: The Supreme Court noted in 2024 that misleading ads from fast-moving consumer goods (FMCG) companies were harming vulnerable groups—babies, schoolchildren, and seniors.
